Privacy Policy

This Privacy Policy explains how we collect, use, disclose, and protect your information when you visit thesimonshi.com and related pages, products, or services (collectively, the “Site”). By using the Site, you agree to this Policy. If you do not agree, please discontinue use.

1. Who We Are

The Site is owned and operated by Simon Shi (the “Company,” “we,” “our,” or “us”). We provide triathlon coaching, digital content, and related services.

2. Scope

This Policy applies to personal information processed in connection with the Site, coaching programs, newsletters, courses, and any other online services that link to it.

A. Personal Information You Provide

  • Identifiers & Contact Data: name, email address, phone (optional), social handles.
  • Account & Communication Data: messages, inquiries, coaching intake forms, preferences.
  • Transaction Data: purchase history, billing details (processed by payment providers; we do not store full card numbers).
  • User-Generated Content: comments, testimonials, submissions, forms, survey responses.
  • Health/Training Context (optional): information you choose to share about goals, training history, or relevant medical clearances to tailor coaching. Do not share sensitive medical details you’re not comfortable providing.

B. Information Collected Automatically

  • Device & Usage Data: IP address, browser type, device identifiers, pages viewed, time on page, referring/exit pages, and general location derived from IP.
  • Cookies & Similar Technologies: identifiers that help recognize your browser or device and remember preferences. See Section 7.

C. Information from Third Parties

  • Payment Processors: confirmation of payment, last 4 digits of card, transaction status (no full card storage by us).
  • Analytics/Ad Partners: aggregated metrics, audience insights.
  • Social Platforms: when you interact with embedded content or log in via third parties.

We collect information directly from you, automatically via your device/browser, and from service providers (e.g., analytics, email, payment, or scheduling tools).

For visitors in the EEA/UK: Our legal bases include performance of a contract, legitimate interests (e.g., site security, improvement, audience measurement), consent (where required), and compliance with legal obligations.

6. When We Share Information

We do not sell your personal information. We may share:

We use administrative, technical, and organizational safeguards appropriate to the nature of the information we process. No method of transmission or storage is completely secure. If you believe your data has been compromised, contact us immediately.

11. Children’s Privacy

The Site is not directed to children under 13 (or under 16 in the EEA/UK). We do not knowingly collect personal information from children. If you believe a child has provided personal information, contact us and we will take appropriate steps.

We are based in the United States and may process information in countries that may have different data protection laws than your country. Where required, we use appropriate safeguards for international transfers (e.g., Standard Contractual Clauses).

A. Email Marketing

You can unsubscribe from marketing emails at any time by using the link in our emails or contacting us.

B. U.S. State Rights (e.g., CA, CO, CT, UT, VA)

Depending on your state, you may have rights to: (i) know/access, (ii) correct, (iii) delete, (iv) portability, and (v) opt out of sales or sharing for targeted advertising. California residents also have the right to limit the use and disclosure of “sensitive” personal information and to use a “Do Not Sell or Share My Personal Information” control if applicable. If we implement a preference signal (e.g., GPC), we will honor it to the extent required by law.

C. EEA/UK/Swiss Rights

You may have rights to access, rectify, erase, restrict or object to processing, and data portability. Where we rely on consent, you can withdraw it at any time. You also have a right to lodge a complaint with your local supervisory authority (e.g., ICO in the UK).

D. Verifying & Timing

We may request information to verify your identity and authority. We aim to respond within the time frames required by applicable law. Authorized agents may submit requests where permitted, subject to verification.

14. “Do Not Track”

Some browsers transmit “Do Not Track” signals. There is no uniform standard for DNT. We respond to legally required preference signals where applicable and will update this Policy if standards emerge.

15. Changes to This Policy

We may update this Policy from time to time. The “Effective Date” above reflects the latest version. Material changes will be posted on this page; continued use of the Site after changes means you accept the updated Policy.
